User Terms of Service

Please read these terms carefully before using XRadar. By using our service, you agree to these terms.

These Terms of Service ("Terms") govern your access to and use of the XRadar mobile application and related services, including the XRadar+ subscription (collectively, the "Service"), operated by XRadar, Inc. ("XRadar," "we," "us," or "our").

By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & Acceptance

You must be at least 13 years old to use XRadar.

By using the Service, you represent that you have the legal capacity to enter into these Terms.

2. Description of the Service

XRadar provides campus-focused transportation and discovery tools, including:

  • Real-time bus tracking
  • Estimated arrival times
  • Route and schedule information
  • Optional push notifications
  • Campus transportation insights
  • Discovery of participating local businesses

XRadar+

XRadar+ is a paid subscription that provides enhanced access to features, including a monthly credit-based benefit usable at participating businesses, as described below.

Features and participating businesses may change at any time.

3. Accounts & Authentication

To access certain features, including XRadar+, users must authenticate using one of the following methods:

  • Email-based passwordless login
  • Google Sign-In
  • Sign in with Apple

You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your login credentials.

4. XRadar+ Credits & Subscription Benefits

A. Monthly Credit Allocation

XRadar+ subscribers receive ten (10) credits per billing month ("Credits").

  • Credits are issued at the start of each subscription billing cycle
  • Unused Credits do not roll over
  • Credits have no cash value and cannot be redeemed for cash

B. Credit Redemption Limits

  • Each participating business may accept a maximum of two (2) Credits per subscriber per month
  • Businesses may impose additional conditions on redemption (e.g., minimum purchase, eligible items)
  • XRadar does not guarantee availability of any specific offer or business at any time

C. In-Store Redemption Process & Timing

(Important — Redemption Mechanics)

Credits may be redeemed only in person at participating businesses and only through the in-app activation flow.

To redeem a Credit:

  1. The user must initiate redemption within the XRadar app at the time of checkout.
  2. The user must affirmatively activate the Credit, at which point the app will display a time-limited activation screen intended to be shown directly to the merchant.
  3. The activation screen is dynamic, temporary, and non-reusable, and is designed to prevent screenshots, recordings, or reuse.

A Credit is considered redeemed at the moment the activation screen is generated, regardless of whether the transaction is completed.

Once activated:

  • The Credit cannot be reversed, paused, restored, or reused
  • Exiting, dismissing, or allowing the activation screen to expire does not restore the Credit

Merchants are solely responsible for accepting or declining a presented Credit.

XRadar does not guarantee merchant acceptance and is not responsible for disputes arising from a merchant's refusal to honor a Credit.

D. Expiration & Modification

Credits:

  • Expire at the end of each billing month
  • May be modified, suspended, limited, or discontinued as part of changes to XRadar+ features, with notice where required by law

5. Strict Prohibition on Sharing, Transfer, or Abuse

(Important — Please Read Carefully)

XRadar+ subscriptions, Credits, and all associated benefits are personal, non-transferable, and intended for use by a single individual only.

You may not:

  • Share your account with any other person
  • Allow another individual to use your Credits or subscription benefits
  • Sell, trade, gift, lend, or transfer Credits
  • Attempt to pool Credits across multiple users
  • Circumvent monthly limits or business redemption caps
  • Create multiple accounts to obtain additional Credits
  • Exploit or attempt to bypass redemption mechanics

XRadar reserves the right to monitor usage patterns, including activation timing and redemption behavior, to detect fraud, abuse, or misuse.

Enforcement

If XRadar determines, in its sole discretion, that you have violated this section or abused the redemption process, XRadar may:

  • Suspend or terminate your XRadar+ subscription without refund
  • Revoke unused Credits
  • Restrict or permanently disable your account
  • Take any other action permitted by law

This section is enforced strictly and modeled on industry-standard policies used by large technology platforms.

6. Subscription Billing & Renewal (XRadar+)

  • XRadar+ is offered as a monthly auto-renewing subscription
  • Subscriptions are processed via Stripe, surfaced through Superwall
  • Your subscription renews automatically unless canceled before the renewal date

Cancellation

You may cancel at any time through the method provided in-app.

Cancellation takes effect at the end of the current billing period. No partial refunds are provided unless required by law.

7. Refunds, Credits, and Disputes

A. Subscription Fees

XRadar+ subscription fees are non-refundable.

We do not provide refunds for partial billing periods, unused Credits, or time remaining after cancellation, except where required by law.

B. Activated Credits Are Final

A Credit is considered redeemed at the moment it is activated, when the time-limited activation screen is displayed.

Once activated:

  • Credits cannot be reversed, restored, or refunded
  • Allowing the activation screen to expire does not reinstate the Credit
  • Closing or exiting the app does not reinstate the Credit

C. Merchant Refusal

If a merchant declines to accept a properly presented activation screen:

  • XRadar is not obligated to refund or reinstate the Credit
  • Merchant acceptance is outside XRadar's control

XRadar may, in its sole discretion, review and issue a one-time courtesy adjustment in limited circumstances. Courtesy adjustments are not guaranteed and do not create precedent.

D. User Error & Misuse

Refunds or Credit reinstatements will not be issued for:

  • Accidental or premature activation
  • Failure to present the activation screen
  • Attempted redemption outside permitted limits
  • Account or Credit sharing
  • Violations of these Terms

E. Technical Issues

If a Credit fails to activate due to a verifiable technical error attributable to XRadar, XRadar may investigate and, if confirmed, restore or replace the Credit.

Device issues, connectivity problems, or merchant point-of-sale issues are not considered XRadar technical failures.

F. Abuse & Excessive Disputes

XRadar monitors dispute activity. Excessive or abusive refund requests may result in:

  • Denial of future disputes
  • Revocation of Credits
  • Suspension or termination of the account

G. Chargebacks

Initiating a chargeback without first contacting XRadar may result in:

  • Immediate suspension of XRadar+ access
  • Permanent account termination
  • Loss of unused Credits

XRadar may contest chargebacks using activation and usage records.

8. Data Accuracy and Reliability

(Bus Tracking Disclaimer)

While XRadar strives to provide accurate and up-to-date bus tracking information, we do not guarantee the accuracy, completeness, or reliability of any transportation data displayed through the Service.

Bus locations, schedules, and estimated arrival times may change or be inaccurate due to factors beyond XRadar's control, including:

  • Traffic conditions
  • Weather events
  • Mechanical or operational issues
  • Human error
  • Delays or inaccuracies in third-party data feeds

Users should not rely solely on XRadar for critical or time-sensitive transportation decisions and should maintain alternative transportation plans when necessary.

9. Service Availability

XRadar aims to provide continuous access to the Service; however, we do not guarantee uninterrupted or error-free operation.

The Service may be temporarily unavailable due to:

  • Scheduled or emergency maintenance
  • Technical difficulties
  • Third-party service disruptions
  • Network failures
  • Force majeure events beyond our reasonable control

XRadar shall not be liable for losses resulting from service interruptions.

10. Third-Party Services

XRadar may integrate or rely on third-party services and data providers to provide transportation information.

XRadar is not responsible for:

  • The availability of third-party services
  • The accuracy, timeliness, or completeness of third-party data
  • The content or performance of third-party systems

Your use of such services may be subject to their own terms and policies.

11. Acceptable Use

You agree not to:

  • Use the Service for unlawful or abusive purposes
  • Reverse engineer, decompile, or extract source code
  • Interfere with or disrupt the Service
  • Circumvent paywalls or subscription mechanisms
  • Use automated systems to misuse Service data

12. Ads & Sponsored Content

XRadar may display sponsored listings or promotional content.

XRadar does not endorse and is not responsible for third-party offers.

13. Intellectual Property

All rights, title, and interest in the Service are owned by XRadar or its licensors.

You are granted a limited, revocable, non-transferable license for personal, non-commercial use.

14. Termination

XRadar may suspend or terminate your access if you violate these Terms or misuse the Service.

Upon termination, all rights to use the Service immediately cease.

15. Disclaimer of Warranties

The Service is provided "as is" and "as available."

XRadar disclaims all warranties to the fullest extent permitted by law.

16. Limitation of Liability

XRadar shall not be liable for indirect, incidental, or consequential damages.

Total liability shall not exceed the amount paid in the 12 months preceding the claim.

17. Indemnification

You agree to indemnify and hold harmless XRadar from claims arising out of your use of the Service or violation of these Terms.

18. Dispute Resolution

Most disputes will be resolved by binding arbitration.

Either party may pursue claims in small claims court or seek injunctive relief where appropriate.

Class actions are waived to the extent permitted by law.

19. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

20. Changes to These Terms

We may update these Terms periodically. Continued use of the Service constitutes acceptance of the revised Terms.
